Terms and Conditions as of February 2008

1. GENERAL

All bookings are made subject to acceptance of the terms and conditions stipulated below.

2. BOOKINGS

Provisional Confirmation of Availability and Rates

Upon receipt of a request for availability, the applicable villa rates and the amount of deposit required will be confirmed.

Initial Deposit
An initial deposit of 10% of the villa rental is required to confirm a booking. No contractual obligation will exist prior to receipt of funds. If funds are not received within 5 banking days, the reservation shall be deemed to have been cancelled. A further 40% on or before 12 weeks prior to arrival and the remaining 50% on or before 30 days prior to arrival. Bookings made within 30 days of arrival require payment to be made in full at the time of reservation.

Rates

Villa rental rates quoted are on a per day basis  (minimum 1 weeks rental) and quoted in EURO's as shown on the website. Only those persons stipulated on the booking form may reside at the property as guests. Please notify us as soon as possible of any changes. The cost of airport pickup, electricity, water, cleaning, gardening supplies and local taxes are included in the rental rates, unless otherwise specified. The villa is fully equipped with linen, crockery and utensils. Wireless Internet access is available and telephones. All call charges will have to be settled before departure. The use of a car is included; all drivers must hold a current international driving licence under Thai law.

Not included / additional charges.

Rates do not include baggage handling, gratuities, telephone, fax and telegram charge, personal items and expenses and any excessive cleaning required upon departure (such as upholstery or rug shampooing, etc). or replacement of breakages. Fair wear and tear accepted.

3. PAYMENT

Balance
Payment of the outstanding balance must be received at least 30 days before the arrival date. Should the balance not be received by the due date, we reserve the right to cancel the booking, and cancellation charges will apply.

4. CANCELLATION

You may cancel your reservation at any time by notifying us in writing by email and receiving conformation of cancellation. The following cancellation terms apply. More than 12 weeks prior to arrival forfeiture of the 10% deposit. Between 12 weeks and 14 days prior to arrival forfeiture of the 50% deposit. 14 days prior to arrival the total cost. If it becomes necessary to cancel all or any part of the booking, you must notify us by email. The cancellation will take effect from the day the written confirmation is received. The above cancellation charges also apply if we cancel the booking due to non-payment of the balance. 

5. AMENDMENT TO BOOKING

Amendments to bookings is subject to approval by the villa's owner.

6. ARRIVAL AND DEPARTURE

Guests should assume the check-in time is after 12 noon, and checkout time is prior to 12 noon, unless otherwise specified or agreed. Account will be taken where possible of flight arrival/departure times. We will try to be flexible where possible and check in / check out times can be confirmed prior to arrival.

7. AMENDMENT OR CANCELLATION BY BAN SURIYAN CHANDRA

Though it is unlikely that the villas owners/management will have to make any changes to confirmed arrangements we will advise you at the earliest possible date. If the property is damaged or rendered unusable or for any reason beyond our control or due to unexpected circumstances we are unable to provide you with the villa, we will endeavour to find alternative accommodation if requested. If this is not possible, or you do not wish to be transferred,  the villas owners/management will cancel the booking and refund you in full.

We shall not be liable for any further obligations or claims by the client.

8. REGISTERED GUEST

Only those persons stipulated on the booking form may reside at the property as guests. Please notify us as soon as possible of any changes. The number of people staying at the property must not exceed the maximum capacity specified, except in the case of infants (under two years old), or unless specifically authorised.

Should the owner/management of the villas find that the number of people staying at the property exceeds that on the booking form, additional guests will be subject to a per person, per day surcharge and/or may be asked to vacate the premises. No camping is permitted in the property grounds and we regret that no pets are allowed.

9. SECURITY DEPOSIT

A security deposit is payable in euro's at a price to be decided at the time prior to arrival. Payment can be made in other currenies as appropriate. This is to cover the cost of any damage or breakages during the rental period of the Villa or their contents. It may also be used to cover the cost of telephone calls and other services. This amount will be returned to you at the time of departure, less any such costs.

10. INSURANCE

It is a condition of the booking that the entire party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including local treatment, evacuation and repatriation coverage). As deposits and rental payments may not be refundable after a reservation has been confirmed, you should consider an option of this travel insurance to cover the loss of money paid to the villa in case of cancellation of your journey.

The villas owners/management are not responsible and are held harmless by you and your party against any and all claims including any accidents related to the use of the Villa facilities or locally procured third party services such as, but not limited to, watercraft, water sports, jeep or motorbike rental.

The villas owners/management shall not be responsible for any loss, delay, damage, additional expense or inconvenience caused directly or indirectly by events outside their control such as civil disturbances, fires, floods, severe weather, acts of God, acts of Government etc.

By acceptance of this contract it is assumed by the villas owners/management that this requirement has and will be complied with in full.

11. LIABILITY

Under no circumstances shall the villa owner/ management be responsible for any loss, expense, damage, claim or injury either directly or indirectly, consequential or otherwise whatsoever, however caused or incurred, whether arising in contract or otherwise in law or equity as a result of rendering of the services, use of the gymnasium or accommodation as described or substituted, or by reason of military action, revolution or acts of God, or by any agents, employees, subcontractors, servants or third parties whatsoever supplying any of the services or accommodation herein or as substituted.

12. COMPLAINTS

The property description provided on the website and elsewhere are made in good faith and provide the accurate information without any alterations, as provided by the villas owners and/or management. We highly recommend you to read them carefully.

We accept no responsibility for the following:

- any modifications made by the villas owners/management that are not mentioned on the web page or anywhere else

- the breakdown of the supply of water, or electricity, or swimming pool filtration systems

However, shall you contact us during such problem, we will use our best endeavours to arrange for any such problems to be solved quickly. Any complaints must be notified to the villa owner & management within 24 hours of the occurrence giving rise to the complaint. Should a problem remain unsolved please make a complaint in writing to the villas owner (ian @ ban-suriyan-chandra.net) within 7 days of the completion of the rental period. If the Villa is vacated before the end of the rental period without mutual agreement this may result in the loss of all rights to compensation.

No claim can be done after the villa has been vacated without having made a notification at the time of the problem occurrence to the villas management.

No picture nor video are applicable for claim if neither a representative of the villas owners/management are present at the time the pictures or the video are taken.

13. CONDUCT AND BEHAVIOUR

The person paying the deposit amount for the villa rental is responsible for the correct and appropriate behaviour of the guests staying at the Villa. Should any member of the party not behave in such a manner, the villas owner/management  may at their absolute discretion ask the offending guest or guests to vacate the Villa forthwith. No food or substance must be put into the fish ponds or their filters whatsoever by guests.

In respect of the villas owners and primarily for security reasons, it is absolutely prohibited for the guests to bring a male or female prostitute within the compound of the villa.

No smoking is permitted indoors.

14. STAFF

The Villa includes the services of 2 maids and a manager (as minimum). Additional services such as those of cooks, masseurs and/or drivers can be provided. Please give ample notice as soon as possible; especially at peak holiday seasons and we shall try to assist.

The villa owner / management can assume no liability for such contracted out staff. The rates for additional services are as shown on the website (or available by request) .

15. VALUABLES

The villas is equipped with a safe in each bedroom. All rooms are individually alarmed. Any valuables left at the property are at one's own risk. Neither the villas owners/management nor their staff is responsible for their loss or damage.

16. DUE CARE

Guests are required to take due care when residing at the villa (especially children) around the gardens, the stairways, the ponds, Jacuzzi, swimming pools, the gymnasium, near or in the entrance, the road, on the beaches / including the sea.

Handling of furniture, crockery and other artifacts shall be done with the maximum care. The villas staff are there to help if necessary.

Guests are reminded not to enter the Villas wet or to run around the swimming pool/plunge pool as the floors can be slippery. Damage or injury arising shall not be the responsibility of  the villas owners/management in any way whatsoever.

17. APPLICABLE LAW

These conditions and any contract to which they apply are governed in all respects by the applicable Thai law, and the Thai courts only shall have jurisdiction in relation to any claim or dispute arising out of, or connected with them.
